We are seeking community feedback on the proposed Amended Cemetery Operations Policy.
The policy has been updated to reflect recent changes to the Cemeteries and Crematoria Act 2013, including changes relating to the interment of animals. The amendments also clarify operational matters such as interment rights, scattering of ashes, memorials and use of limited cemetery space across the Kiama Local Government Area.
The current Cemetery Operations Policy was adopted in November 2023. Since then, minor legislative changes have occurred at the state level. The proposed amendments ensure Council’s policy remains up to date, legally compliant and clear for the community.
The changes also respond to capacity constraints in several local cemeteries and aim to support fair and consistent management into the future.
Key proposed changes include:
- Clarifying that animal remains, including ashes, are not permitted to be interred in Council cemeteries.
- Requiring Council approval for the scattering of ashes on Council‑owned or managed land.
- Updating limits on interment rights to reflect limited capacity in some cemeteries.
- Clarifying arrangements for interment times and additional fees outside standard hours.
- Updating requirements for memorials, plaques and proof of interment rights.
After the exhibition period:
- If submissions are received, Council will consider the feedback and any proposed changes in a further report.
- If no relevant submissions are received and no further changes are proposed, Council may proceed to adopt the policy.
